MANILA – Pinagtibay ng Commission on Elections (Comelec) ang desisyon ng Second Division nito na ibasura ang petisyon na kanselahin ang certificate of candidacy (COC) ni presidential candidate Ferdinand “Bongbong” Marcos Jr., dahil sa hindi paglalahad ng mga bagong argumento.

Sa limang pahinang resolusyon, sinabi ng Comelec en banc na ibinasura ang motion for reconsideration ni Danilo Lihaylihay dahil inulit lang nito ang mga argumento ng petitioner. Nanindigan ang poll body na “walang matinding batayan upang kwestyunin ang mga konklusyon ng Komisyon (Ikalawang Dibisyon).”

“A careful review of the Motion for Reconsideration reveals that it contains merely a rehash of petitioner’s averments and arguments,” sabi nito.

“The Motion failed to raise new matters or issues, and the grounds that would warrant the reversal of the Assailed Resolution,” dagdag ng Comelec.

“It is apparent on the face of the Motion that there is no cogent reason to disturb the findings of the Commission (Second Division),” isinaad nito.

“Wherefore, in view of the foregoing, the Commission (En Banc) denies (the) respondent’s Motion for Reconsideration dated 22 December 2021 and affirms the Resolution of the Commission (Second Division) promulgated on 16 December 2021,” dagdag ng desisyon.

Noong Oktubre 2021, inihain ni Lihaylihay ang petisyon na humihimok sa poll body na ideklara si Marcos bilang isang nuisance candidate.

Makalipas ang dalawang buwan, binasura ng Comelec Second Division ang petisyon. Kasunod na inapela ng petitioner ang kaso sa Commission en Banc.

Ibinasura rin ng Comelec ang mga MR na inihain ni Bonifacio Ilagan, Akbayan Party, Abubakar Mangelen; at ang apela ni Fr. Christian Buenafe, bukod sa iba pa, laban kay Marcos, na humihiling na i-disqualify ang huli sa pagtakbo sa presidential race.
