MANILA – Ibinasura ng Commission on Elections (Comelec) First Division ang natitirang disqualification case na inihain ng grupong Pudno nga Ilokano laban kay presidential candidate Ferdinand “Bongbong” Marcos Jr.
Ang 29-pahinang desisyon ng Dibisyon na binubuo nina Presiding Commissioner Socorro Inting at mga miyembro, Commissioners Aimee Ferolino at Aimee Torrefranca-Neri, ay nilinis ang presidential frontrunner sa lahat ng kaso sa antas nito.
“Wherefore, premises considered, the instant Petition is hereby denied for lack of merit,” ayon sa desisyon.
Ang First Division ay walang nakitang moral turpitude sa kaso, gaya ng pinagtatalunan ng mga petitioner batay sa mga paghatol kay Marcos sa tax evasion.
“Nonetheless, we find it more prudent to make our own assessment to remove all doubts and finally resolve the controversy. An assiduous study of the records and relevant jurisprudence yields to a conclusion that there is no moral turpitude in this case,” ayon sa ruling.
“If failure to file income tax return is considered alone, it would appear that it is not inherently wrong. This is supported by the fact that the filing of income tax return is only an obligation created by law and the omission to do so is only considered as wrong because the law penalized it,” dagdag nito.
Nag-ugat ang kaso sa paghatol kay Marcos dahil sa hindi pag-file ng kanyang income tax returns (ITRs) mula 1982 hanggang 1985.
Ang iba pang mga petisyon para ideklarang nuisance si Marcos, kanselahin ang certificate of candidacy at i-disqualify ang tatlong pinagsama-samang kaso ay na-dismiss ngunit naghain ang mga petitioner ng motion for reconsideration na nakabinbin ngayon sa Comelec en banc.
‘Oras na para pagsikapan ang malinis, tapat na halalan’
Sinabi ng kampo ni Marcos na panahon na para pagsikapan ang malinis at tapat na halalan dahil malugod nitong tinatanggap ang pagbasura sa disqualification case laban sa dating senador.
“The Commission on Elections has affirmed and settled the last petition for disqualification: Presidential frontrunner Bongbong Marcos possesses all the qualifications needed to aspire for, campaign and serve as president of the Republic of the Philippines,” wika ng abogadong si Vic Rodriguez, tagapagsalita ni Marcos, sa isang pahayag.
Ayon kay Rodriguez, dapat ayusin ang halalan sa pamamagitan ng mga balota, at hindi sa pamamagitan ng “pag-abuso” sa mga proseso ng hudisyal tulad ng paghahain ng “nuisance petitions” para sa diskwalipikasyon.
“It is now time for every peace-loving Filipino to work for a clean, honest, credible and fair elections, and allow the people to speak, their voices heard and votes genuinely counted,” wika niya.
Ikinatuwa din ni Marcos ang desisyon, at sinabing “it’s a good development and we’re happy that it happened before the upcoming elections.”
Siya ay kasalukuyang nasa Occidental Mindoro para sa kanyang campaign sortie.
Ang petisyon ni Pudno, na kinakatawan ni dating Comelec Commissioner Christian Monsod, ay inihain noong Disyembre 7, 2021.
Mula nang magsimula ang kampanya, si Marcos at ang kanyang running mate na si Davao City Mayor Sara Duterte ay patuloy na nangunguna sa lahat ng major pre-election surveys.
