MANILA – Desidido pa rin si Pangulong Rodrigo Duterte na wakasan ang “mapang-abusong” kaayusan sa trabaho sa bansa, inihayag ng Malacañang nitong Huwebes.
Ito, matapos magpahayag ng pagkadismaya si vice presidential aspirant Senate President Vicente Sotto III sa umano’y kabiguan ni Duterte na tuparin ang kanyang pangako na itigil ang hindi patas na mga gawi sa kontraktwalisasyon matapos i-veto ng Chief Executive ang Security of Tenure bill noong 2019.
Sa isang pahayag, sinabi ni acting Presidential Spokesperson at Communications Secretary Martin Andanar na bineto ni Duterte ang panukala dahil sa ilang hindi angkop na probisyon.
“While it is true that President Rodrigo Roa Duterte vetoed the Security of Tenure Bill in 2019, as mentioned by Senate President Vicente Sotto III, the Chief Executive explained that the version submitted by Congress unduly broadens the scope and definition of prohibited labor-only contracting, effectively proscribing forms of contractualization that are not particularly unfavorable to employees involved,” wika ni Andanar.
Inaasahan ni Duterte, ani Andanar, ang Kongreso na gagawa ng bagong panukala na naglalaman ng mga katanggap-tanggap na probisyon na makikinabang sa sektor ng paggawa at negosyo.
“The President hopes that Congress would rectify the vetoed provisions as he remains committed to eradicating all forms of abusive employment practices and protecting the workers’ right to security of tenure,” aniya.
Sa kabila ng pagtanggi ni Duterte sa Security of Tenure bill, binanggit ni Andanar na pumirma ang Chief Executive ng executive order (EO) noong 2018 para ihinto ang “illegal” contracting at subcontracting arrangements sa pagitan ng mga employer at kanilang mga empleyado.
Sinabi ni Andanar na ang EO 51, na nilagdaan ni Duterte noong Mayo 1, 2018, ay naglalayong protektahan ang karapatan ng mga manggagawa sa seguridad ng panunungkulan.
“A clear example is Executive Order No. 51 which PRRD signed in 2018 that strictly prohibits contracting or subcontracting undertaken to circumvent the worker’s right to security of tenure, self-organization and collective bargaining, and peaceful concerted activities,” wika ni Andanar.
Noong Hulyo ng nakaraang taon, inulit ng Malacañang ang panawagan nito sa Kongreso na ipasa ang panukalang Security of Tenure Act na nananatiling priority measure ng executive branch.
Nagpahayag din ng kumpiyansa si Labor Secretary Silvestre Bello na maipapasa ng 18th Congress ang bagong bersyon ng Security of Tenure bill.
Ang panukala ay naglalayong amyendahan ang Presidential Decree 442 o ang Labor Code of the Philippines upang matiyak na ang mga karapatan at benepisyo ng mga reliever at seasonal na empleyado ay kapantay ng mga regular na empleyado.
